1. Scope

1.1 AnyNews provides this DMCA Policy ("Policy") as a procedure for copyright holders to report alleged infringement of their works on the Service. It applies to all User Content and AI Output published through AnyNews.

1.2 This Policy is incorporated into our Terms of Service and uses the same defined terms.

1.3 Disclaimer regarding safe harbor. As stated in the summary above, AnyNews has not registered a designated agent with the US Copyright Office. We therefore do not claim formal safe-harbor protection under 17 USC §512(c). This Policy describes our voluntary procedure for handling copyright complaints in good faith.

2. Notice of alleged infringement

If you believe content on AnyNews infringes a copyright you own or are authorized to enforce, send us a notice that includes:

2.1 Identification of the work

A clear description of the copyrighted work you believe is being infringed. If multiple works, a representative list with sufficient detail to identify each.

2.2 Identification of the alleged infringement

A clear description of where on the Service the allegedly infringing content is located (URL, channel name, post identifier, screenshot). Be specific enough that we can find it.

2.3 Your contact information

Your full legal name, postal address, telephone number, and email address.

2.4 Statement of good-faith belief

A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

2.5 Statement of accuracy

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

2.6 Signature

A physical or electronic signature.

2.7 Where to send

Email to info@anynews.ai with the subject line "DMCA Notice". Postal notices are not accepted; we use email exclusively to ensure timely review.

3. What happens next

3.1 Review

We review every legitimate DMCA notice. We aim to respond within 10 business days, though complex cases may take longer.

3.2 Possible actions

If the notice appears valid, we may:

• Remove or disable access to the allegedly infringing content.
• Notify the user who posted the content of the complaint and provide a copy of the notice (excluding your personal contact details where not necessary).
• Take additional action against the user's account in cases of repeated or willful infringement, including suspension or termination.

3.3 If the notice is deficient

If your notice is missing required information, we may ask you to supplement it before taking action.

3.4 Frivolous or abusive notices

Submitting a notice in bad faith - for example, to remove content you do not actually have copyright in, or to suppress legitimate fair use - may expose you to liability under 17 USC §512(f) and to similar penalties under other laws.

4. Counter-notice (for users whose content was removed)

If your content was removed in response to a DMCA notice and you believe the removal was an error or that your use was authorized (for example, by fair use), you may send us a counter-notice.

4.1 Counter-notice requirements

Your counter-notice must include:

• Identification of the removed content and the location it appeared.
• A statement, under penalty of perjury, that you have a good-faith belief that the content was removed in error or as a result of misidentification.
• Your full legal name, postal address, telephone number, and email address.
• A statement that you consent to the jurisdiction of the courts where you live (or, if outside the United States, of any judicial district in which AnyNews may be found).
• A statement that you will accept service of process from the person who filed the original notice.
• Your physical or electronic signature.

4.2 Where to send

Email to info@anynews.ai with the subject line "DMCA Counter-Notice".

4.3 What happens next

We will forward your counter-notice to the original complainant. We may restore the content if the original complainant does not initiate legal action within a reasonable period (typically 10 to 14 business days for safe-harbor systems; we will use a similar timeframe here as good practice). Restoration is at our discretion since we do not operate under formal safe-harbor procedures.

5. Repeat infringers

We may suspend or terminate accounts that we determine to be repeat infringers of copyright. Determination of repeat infringement is at our discretion, taking into account factors including the number of valid complaints, the severity of the infringement, the user's response, and the time period over which infringements occurred.

6. Our limitations

6.1 We are a tool

AnyNews is a publishing tool. Content posted through the Service is the responsibility of the user who posts it. Our handling of DMCA notices does not constitute an admission of liability for any allegedly infringing content.

6.2 No legal advice

This Policy describes our procedure. It is not legal advice. If you are unsure about whether a use is infringing or whether to send a notice, consult a lawyer.

6.3 Other claims

Notices for non-copyright concerns (defamation, privacy violations, trademark infringement, etc.) should be sent to info@anynews.ai with a description of the complaint. They are not handled under this Policy.

7. Changes to this Policy

We may update this Policy at any time. Material changes are notified per our Terms of Service §15.1.
